Please read these Terms of Use carefully before accessing or using any part of the Tijykoy platform. By accessing or using our services, you confirm that you have read, understood, and agree to be bound by these Terms. If you do not agree, you must not use the platform.
1. Definitions
Throughout these Terms, the following definitions apply:
- Platform refers to the website, applications, tools, and services operated by Tijykoy and accessible via tijykoy.com.
- User refers to any individual who accesses, browses, registers on, or otherwise interacts with the Platform.
- Account refers to a registered profile created by a User to access features of the Platform.
- Content refers to all text, video, audio, materials, presentations, data, and other information made available on or through the Platform.
- Services refers to all features, functions, webinars, tools, and offerings provided by Tijykoy through the Platform.
- We, Us, Our refers to Tijykoy.
2. Acceptance of Terms
By creating an Account, registering for a webinar, or otherwise using the Platform in any capacity, you enter into a binding agreement with Tijykoy under these Terms of Use, together with any additional policies referenced herein, including our Privacy Policy.
If you are using the Platform on behalf of an organisation or legal entity, you represent that you have the authority to bind that entity to these Terms, and references to "you" shall include that entity.
We reserve the right to update or modify these Terms at any time. Changes become effective upon publication on the Platform. Continued use of the Platform following any change constitutes your acceptance of the revised Terms.
2. Eligibility
To use the Platform, you must:
- Be at least 18 years of age, or the age of majority in your jurisdiction, whichever is greater;
- Have the legal capacity to enter into binding agreements;
- Not be prohibited from receiving services under applicable laws.
By using the Platform, you represent and warrant that you meet all eligibility requirements. We may refuse access or terminate Accounts if we have reason to believe eligibility conditions are not met.
3. Account Registration and Security
3.1 Creating an Account
Certain features of the Platform require you to register for an Account. When registering, you agree to provide accurate, current, and complete information and to keep that information updated at all times.
3.2 Account Credentials
You are solely responsible for maintaining the confidentiality of your login credentials. You must not share your password or permit any other person to use your Account. You agree to notify us immediately at support@tijykoy.com if you suspect any unauthorised access to your Account.
3.3 Account Responsibility
All activities that occur under your Account are your responsibility, whether or not you authorised them. Tijykoy is not liable for any loss or damage arising from unauthorised use of your Account resulting from your failure to safeguard your credentials.
4. Use of the Platform
4.1 Permitted Use
You may use the Platform solely for lawful purposes and in accordance with these Terms. The Platform is intended to facilitate access to webinars, educational content, and interactive communication tools related to decision making and professional development.
4.2 Prohibited Conduct
You must not, under any circumstances:
- Use the Platform for any unlawful, fraudulent, or harmful purpose;
- Impersonate any person or entity, or misrepresent your affiliation with any person or entity;
- Transmit unsolicited commercial communications, spam, or chain messages;
- Attempt to gain unauthorised access to any part of the Platform, its servers, or connected systems;
- Introduce viruses, malware, or any other malicious or technologically harmful material;
- Scrape, harvest, or systematically collect data from the Platform without prior written consent;
- Reverse engineer, decompile, or disassemble any component of the Platform;
- Use automated tools, bots, or scripts to interact with the Platform in any manner not expressly permitted;
- Interfere with or disrupt the integrity or performance of the Platform or its infrastructure;
- Record, reproduce, or redistribute any live or recorded webinar content without explicit written authorisation;
- Engage in conduct that is abusive, harassing, threatening, or discriminatory toward other Users or staff.
4.3 Compliance with Laws
You are responsible for ensuring that your use of the Platform complies with all applicable laws and regulations in your location. Tijykoy makes no representation that the Platform is appropriate or available for use in all locations.
5. Webinars and Live Sessions
5.1 Registration and Access
Access to specific webinars may require separate registration or payment. Details regarding each event, including scheduling, format, and any associated fees, will be presented at the time of registration.
5.2 Session Conduct
During live sessions, you agree to conduct yourself respectfully and professionally. Tijykoy reserves the right to remove any participant from a session without notice or refund if their conduct is deemed disruptive, abusive, or otherwise in breach of these Terms.
5.3 Recording and Replay
Tijykoy may record webinars and make recordings available to registered participants. You must not record, capture, or redistribute session content through any means without our prior written permission.
5.4 Cancellations and Rescheduling
We reserve the right to cancel, reschedule, or modify any webinar at our discretion. Where a paid session is cancelled by Tijykoy, we will offer either a rescheduled alternative or a refund, as appropriate. We are not liable for any indirect costs incurred by Users as a result of such changes.
6. Intellectual Property
6.1 Ownership
All Content on the Platform, including but not limited to text, graphics, logos, video recordings, presentations, software, and course materials, is the property of Tijykoy or its licensors and is protected by applicable intellectual property laws.
6.2 Limited Licence
We grant you a limited, non-exclusive, non-transferable, revocable licence to access and use the Platform and its Content solely for your personal, non-commercial use in connection with the Services. This licence does not permit you to copy, distribute, modify, create derivative works from, or exploit any Content without our express written consent.
6.3 User-Submitted Content
If you submit, post, or share any content through the Platform, including questions, comments, or feedback during sessions, you grant Tijykoy a worldwide, royalty-free, perpetual licence to use, reproduce, and display that content in connection with operating and improving the Services. You represent that you have all rights necessary to grant this licence.
7. Payments and Refunds
7.1 Fees
Certain Services are offered on a paid basis. All applicable fees will be clearly disclosed prior to purchase. By completing a transaction, you authorise Tijykoy to charge the stated amount through your selected payment method.
7.2 Payment Processing
Payments are processed through third-party payment providers. By making a payment, you also agree to the terms and conditions of the relevant payment processor. Tijykoy does not store full payment card details.
7.3 Refund Policy
Refund eligibility is determined on a case-by-case basis. Requests for refunds must be submitted to support@tijykoy.com within the timeframe specified at the point of purchase. We reserve the right to decline refund requests where the Content has already been accessed or where the request falls outside the stated refund window.
7.4 Taxes
You are responsible for any applicable taxes arising from your use of the Services. Displayed prices may or may not include applicable taxes, which will be clarified at checkout.
8. Third-Party Links and Services
The Platform may contain links to third-party websites, tools, or services that are not owned or controlled by Tijykoy. We provide these links for convenience only and do not endorse, control, or accept responsibility for the content, privacy practices, or terms of any third-party services.
Your interactions with third-party services are governed solely by their own terms and policies. We encourage you to review those terms before engaging with any external service.
9. Privacy
Your use of the Platform is also governed by our Privacy Policy, which is incorporated into these Terms by reference. 10. Disclaimers
10.1 No Professional Advice
Content provided through the Platform, including webinar presentations and materials, is intended for informational and educational purposes only. Nothing on the Platform constitutes professional, legal, financial, medical, or other specialist advice. You should seek qualified professional guidance before making decisions based on any information obtained through the Platform.
10.2 Platform Availability
We strive to maintain continuous and reliable access to the Platform but do not guarantee uninterrupted availability. The Platform may be temporarily unavailable due to maintenance, technical issues, or circumstances beyond our control. We are not liable for any loss resulting from such interruptions.
10.3 As-Is Basis
The Platform and all Services are provided on an "as is" and "as available" basis without warranties of any kind, whether express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.
11. Limitation of Liability
To the fullest extent permitted by applicable law, Tijykoy, its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of or inability to use the Platform or Services, even if we have been advised of the possibility of such damages.
Our total aggregate liability to you for any claim arising under or in connection with these Terms shall not exceed the total amount paid by you to Tijykoy in the twelve months preceding the event giving rise to the claim, or a nominal fixed sum where no payment has been made.
12. Indemnification
You agree to indemnify, defend, and hold harmless Tijykoy and its affiliates, officers, employees, agents, and licensors from and against any claims, liabilities, damages, losses, costs, and expenses (including reasonable legal fees) arising out of or relating to:
- Your use of the Platform or Services;
- Your violation of these Terms;
- Your violation of any rights of a third party;
- Any content you submit or transmit through the Platform.
13. Termination
13.1 Termination by You
You may stop using the Platform at any time. To close your Account, contact us at support@tijykoy.com. Termination of your Account does not entitle you to a refund of any fees paid.
13.2 Termination by Us
We reserve the right to suspend or permanently terminate your access to the Platform, with or without notice, if we determine that you have violated these Terms, engaged in conduct harmful to other Users or to Tijykoy, or for any other reason at our reasonable discretion.
13.3 Effect of Termination
Upon termination, your right to access the Platform and its Content ceases immediately. Provisions of these Terms that by their nature should survive termination shall remain in full force, including sections on intellectual property, disclaimers, limitation of liability, and indemnification.
14. Modifications to the Platform
Tijykoy reserves the right to modify, suspend, or discontinue any aspect of the Platform or its Services at any time, including the availability of any feature, content, or tool. We will endeavour to provide reasonable notice of material changes where practicable, but are not obligated to do so.
15. Governing Terms and Dispute Resolution
These Terms represent the entire agreement between you and Tijykoy with respect to your use of the Platform and supersede all prior agreements, representations, and understandings.
In the event of any dispute arising out of or relating to these Terms or your use of the Platform, both parties agree to first attempt to resolve the matter through good-faith negotiation. If the dispute cannot be resolved informally within thirty days, it shall be referred to binding arbitration or the appropriate dispute resolution body as determined by Tijykoy, unless otherwise required by applicable law.
Nothing in this section prevents either party from seeking injunctive or other equitable relief where necessary to protect intellectual property rights or prevent irreparable harm.
16. Severability
If any provision of these Terms is found to be invalid, unlawful, or unenforceable by a competent authority, that provision shall be modified to the minimum extent necessary to make it enforceable, or severed from the Terms if modification is not possible. The remaining provisions shall continue in full force and effect.
17. Waiver
No failure or delay by Tijykoy in exercising any right or remedy under these Terms shall constitute a waiver of that right or remedy. A waiver in one instance shall not be deemed a waiver of the same or any other right in the future.
